Note: 40.05[2][d] Using various arguments, tax protesters claim that the Sixteenth Amendment,which grants Congress the power to collect taxes without consideration to apportionment, is not part of the United States Constitution. The Supreme Court has stated that such assertions are political questions beyond federal court jurisdiction.
